This privacy policy (this “Privacy Policy”) explains how Wiz Kid Learning (“WKC” “us”, “our” “we”, or the “Provider”) uses, shares and protects personal information that we collect, including on our domain and any of our respective sub-domains (“Site(s)”) and WKC mobile apps (the “App(s)”). WKC includes WKC Education Inc., Wiz Kid Coding Inc, and their affiliates.
By visiting one of our Sites or purchasing, enrolling in or using our products, services and mobile software application (collectively, the "Service"), you (“you”, “yourself” or the “Customer”) agree to this Privacy Policy for yourself and for any child for whom you are acting. Children under the age of 13 are not permitted to purchase the Service. Children under the age of 18 may provide information to WKC and participate in the Service only with consent of a parent or guardian.
This Privacy Policy is incorporated into the Terms of Service ("TOS") and the definitions of the TOS apply herein.

Notice for European Union Residents
If you are a resident of the European Union ("EU") and you purchase a Service or are otherwise subject to our TOS, you have additional privacy rights described here.

Notice to Residents of the State of California
If you are a resident of the State of California, in the United States of America, and you purchase a Service or otherwise subject to our TOS, you have additional privacy rights described here.

Definitions
Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.
‍Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.
‍Personal Data (or personal information) is any information about an individual from which that individual can be identified. Your name, address, phone number and bank account number are examples of personal data. It does not include data where the identity has been removed (anonymous data). We collect Personal Data from you in various ways, including when you visit the Site(s), create an account with us, purchase, enroll in and use our Services, use our Apps, answer surveys, participate in our social media communities, such as on Facebook, and when you send us feedback.

Information we Collect
If you are a parent, school, employer or other third-party who purchases courses on a student’s behalf, or an agent or business partner who refers or a student to WKC, you represent that you have legal authority or consent to provide us with Personal Data about the student, including their first name, last name, birthdate and email address (if both purchaser and student email is provided).

Account Registration
When you create an account with WKC, we collect the information you provide us, such as your name, email address, phone number, birth date, and payment information, and information about your child or student that you provide. You may choose to share additional info with us and set up other preferences (such as your preferred pronouns).

Ratings and Feedback
When you rate and provide feedback, we collect all of the information you provide in your feedback for marketing purposes.

Communications
When you contact us or we contact you, we collect any information that you provide, including the contents of the messages or attachments you send us.

Video and Audio Data
When you or your child or student use the Service via the video camera or microphone on your device, whether computer or mobile phone, you agree and consent that we may use such applications on your devices to operate the Service. Further, you consent and agree that we may collect information through your devices, including video and audio content. However, WKC is not permitted to sell any of the above-described information in this paragraph, including video and audio content.

Information about your Device
When you log-on to our Site(s) or to our App(s), we automatically receive information from your device, including your IP address and location (“Usage Data”). We and our service providers may use “Cookies” to keep, and sometimes track, information about you, and to create a personalized web experience.
‍When you access the Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
‍We may use and store information about the location of your device if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, and to improve and customize our Service. You can enable or disable location services when you use our Service at any time by way of your device settings.

Cookies
Cookies are small data files that are stored on your device’s web browser. Cookies track where you travel on our Site and what you look at and purchase. You agree to the use of cookies in this way. Most web browsers can be set to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. We and our service providers may also use so-called "pixel tags", "web beacons", "clear GIFs" or similar means (collectively, "Pixel Tags") in connection with some Site pages and HTML-formatted email messages to, among other things, compile aggregate statistics about Site usage and response rates.
‍A Pixel Tag is an electronic image, often a single pixel (1x1), that is ordinarily not visible to Site visitors and may be associated with cookies on the visitors’ hard drives. Pixel Tags allow us to count users who have visited certain pages of the Site, to deliver branded services, and to target our promotional or advertising campaigns and determine their effectiveness.

1. Session Cookies. We use Session Cookies to operate our Service.
2. Preference Cookies. We use Preference Cookies to remember your preferences and various settings.
3. Security Cookies. We use Security Cookies for security purposes.
4. Advertising Cookies. Advertising Cookies are used to serve you with advertisements that may be relevant to you and your interests.

WKC uses Personal Data for various purposes:
1. To provide and maintain our Service;
2. To notify you about changes to our Service;
3, To allow you to participate in interactive features of our Service when you choose to do so;
4. To provide customer support;
5. To gather analysis or valuable information so that we can improve our Service;
6. To market and advertise our services;
7. To enforce and monitor use of Service to ensure compliance with the TOS, this Privacy Policy, and applicable laws;
8. To monitor the usage of our Service to detect, prevent and address technical issues; and,
9. To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.
Please note that WKC does not send marketing communications to minors, but may send offers to parents or other purchasers of the Service unless you opt out of such messages.

WKC will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

Disclosure of Service Providers
We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.
While our Service Providers may change from time to time, as of the effective date of this privacy policy, we use:

Transfers to Service Providers and other countries
Our Service Providers agreements require the Service Provider to access only the user data it needs to deliver the service, keep all user data confidential, and process, use and retain user data only for the purpose of delivering the service in compliance with our agreement, instructions and policies, including this Privacy Policy.
Personal Data may be processed and stored by WKC and our Service Providers in Canada and the U.S. The laws of these countries may permit government or law enforcement authorities to access your Personal Data.

Disclosure of Data
Business Transactions
If WKC is involved in a merger, acquisition, investment or asset sale, your Personal Data may be transferred to a prospective investor or purchaser and to complete the transaction.

Disclosure for Law Enforcement
Under certain circumstances, WKC may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency). In addition, Personal Data may be disclosed to law enforcement or government authorities where WKC believes that a student or other individual is at risk or has reported potentially unlawful activity such as abuse.​

Marketing Purposes
If you are using the Service as a teacher, WKC may disclose an image that may contain your facial features, likeness or any other personal detail pertaining to you, including but not limited your full name, your employment title, or your employer, for marketing purposes. You can contact us if you object to such disclosure.

Legal Requirements
WKC may disclose your Personal Data in the good faith belief that such action is necessary to:
- To comply with a legal obligation
- To protect and defend the rights or property of WKC
- To prevent or investigate possible wrongdoing in connection with the Service
- To protect the personal safety of users of the Service or the public
- To protect against legal liability

Security of Data
The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

You can submit questions, concerns or complaints about our privacy practices or make requests to access or correct your Personal Data by contacting support@wizkidlearning.com. If you are not satisfied with our response, you may have the right to submit a complaint to a privacy regulator in your region.

European Residents
If you are located in the European Economic Area or the United Kingdom, you may have additional rights under the EU General Data Protection Regulation ("GDPR") or UK General Data Protection Regulation (“UK GDPR”). These include:

  • If your personal information is processed based on legitimate interests, you may have the right to object to this processing

  • You may have the right to request to have your personal information deleted or its use restricted

  • You may have the right to ask us to transfer your personal information electronically to you or another organization

  • If we make any decisions about you based solely on automated processing, you may have the right to ask for an explanation or for the decision to be reviewed manually.

  • Where the processing of your personal information is based on consent, you have the right to withdraw this consent at any time. This does not affect the lawfulness of the processing based on consent before your withdrawal. In some cases withdrawing your consent will mean we cannot continue the relationship with you.

California Residents
‍This Privacy Policy Addendum supplements the Privacy Policy and describes additional rights of residents of the State of California.

California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not share personal information with third parties for their own direct marketing purposes.

Our Policy on "Do Not Track" Signals under the California Online Privacy Protection Act (CalOPPA)
We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

California Consumer Privacy Act
The California Consumer Privacy Act (“CCPA”) provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of “Personal Information,” as well as rights to know/access, delete, and limit sharing of Personal Information.

The CCPA defines “Personal Information” to mean “information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” Certain information we collect may be exempt from the CCPA because it is considered public information (i.e., it is made available by a government entity) or covered by a specific federal privacy law, such as the Gramm–Leach–Bliley Act, the Health Insurance Portability and Accountability Act, or the Fair Credit Reporting Act. Your rights are described below:

Right to Notice at Collection Regarding the Categories of Personal Information Collected.

You have the right to receive notice of the categories of Personal Information we collect, and the purposes for which those categories of Personal Information will be used. This notice is provided via this Privacy Policy.

- Identifiers. We collect your name, phone number, contact address and e-mail address when you engage with our website. We use this information to manage and provide the Services that you request, respond to your requests, and to communicate with you about the Services. We collect your social media handle when you interact with our Services through social media. We use this information to improve the user experience and our Service.

- Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). In addition to the identifiers in the above section, our payment processor Service Provider collects your credit card number to provide you with requested Services. WKC does not store this information

- Internet or other similar network activity. We automatically collect information about your browsing history and your interaction with the content of our Services to measure activity, determine the effectiveness of our Services, and improve them.

- Sensory Data. We collect your audio or voice recordings to provide you with Services.

We may use any of the categories of information listed above for other business or operational purposes compatible with the context in which the Personal Information was collected.

We may share any of the above-listed information with Service Providers, as described above. Service Providers are restricted from using Personal Information for any purpose that is not related to our engagement. The types of Service Providers with whom we share information and the services they provide are described in the Privacy Policy. We have not sold any personal information.

Right to Know/Access Information
You have the right to request access to Personal Information collected about you over the past 12 months and information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it. You may submit such a request as described below. To protect our users’ Personal Information, we are required to verify your identity before we can act on your request.

Right to Request Deletion of Information
You have the right to request in certain circumstances that we delete any Personal Information that we have collected directly from you. You may submit such a request as described below. To protect our users’ Personal Information, we are required to verify your identity before we can act on your request. We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

How to Submit a Request
You may submit a request to exercise your rights to know/access or delete your Personal Information by sending us an email at support@wizkidlearning.com

Only you or your authorized agent may make a verifiable consumer request related to your personal information. If you use an authorized agent to submit a request on your behalf, we may require that you (1) provide the authorized agent written permission to do so, and (2) provide a copy of the authorization or provide a copy of a power of attorney that complies with California Probate Code sections 4000 to 4465 so that we can verify the identity of the authorized agent.

In verifying requests, we employ reasonable measures to detect fraudulent requests and prevent unauthorized access to your Personal Information. To meet our obligations, we are required to verify your identity, and the identity of your authorized agent, if the request is submitted via an agent, by associating the information provided in your request to Personal Information previously collected by us.

If we suspect fraudulent or malicious activity on or from the password-protected account, we may decline a request or request that you provide further verifying information.

You may only make a verifiable consumer request twice within a 12-month period. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify your identity or authority to make the request.

Right to Opt Out of Sale of Personal Information to Third Parties
You have the right to opt out of any sale of your Personal Information by us to third parties. We do not sell information to third parties.

Right to Information Regarding Participation in Data Sharing for Financial Incentives
You have the right to be free from discrimination based on your exercise of your CCPA rights. We do not discriminate against anyone who chooses to exercise their CCPA rights.
